User

02Applicability

These terms apply to any use of the platform and to any agreement between Tradavia and the user. Deviations are only valid if agreed in writing. Any purchasing terms of the user are expressly rejected.

03Account & registration

To use Tradavia, you create an account. You are responsible for the accuracy of your information and for keeping your login details confidential. You must inform us immediately of any suspected unauthorized use of your account.

04Trial period

We offer a free trial period of 14 days, no credit card required. After the trial period ends, access stops automatically unless you choose a paid subscription. No rights can be derived from the trial period regarding free continuation.

05Subscriptions & payment

Paid subscriptions are invoiced in advance for the chosen period. Unless stated otherwise, subscriptions are automatically renewed for the same period. Prices exclude VAT unless indicated otherwise.

In case of late payment, we may suspend access to the platform. Amounts already paid will not be refunded, except where required by law.

06Credits & usage

Certain features make use of credits. The number of credits granted depends on your subscription. Unused credits may expire at the end of the period, unless stated otherwise for your subscription. Credits are not exchangeable for money.

07Permitted use

You use the platform in a lawful manner. In particular, it is not permitted to:

  • use the platform in violation of laws, regulations or bol.com's terms;
  • circumvent security or place a disproportionate burden on the infrastructure;
  • unlawfully access or collect data from other users;
  • copy, reverse-engineer or resell the platform or parts of it without permission.

08Availability

We strive for high availability of the platform, but cannot guarantee uninterrupted access. Maintenance, updates or outages may temporarily limit availability. Where possible, we announce planned maintenance in advance.

09Intellectual property

All intellectual property rights to the platform, the software and its content belong to Tradavia or its licensors. You receive a limited, non-exclusive and non-transferable right of use for the duration of your subscription. Your own sales data remains yours.

10Liability

Tradavia provides insights and recommendations to support your decisions; you remain responsible for your own commercial choices. To the extent permitted by law, our liability is limited to the amount you paid in the twelve months preceding the damage. We are not liable for indirect damages or lost profits.

11Cancellation

You can cancel your subscription at any time, effective at the end of the current period, via your account settings or by contacting us. We may terminate the agreement in the event of a serious breach of these terms.

12Changes to the terms

We may amend these terms. We will inform you of significant changes in a timely manner via the platform or by email. If you continue to use the platform after the change takes effect, you agree to the new terms.

13Governing law & disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district where Tradavia is located, unless mandatory law provides otherwise.

Please note — this is a draft version as a starting point. Have the final text reviewed by a lawyer before publication.
